Terms of Service

These terms govern your use of Pombi. By creating an account or using the Service, you agree to them. Please read them carefully — a few clauses describe your responsibilities around billing and around contacting your own customers.
01Acceptance
By accessing or using Pombi (the “Service”), you agree to these Terms of Service and to our Privacy Policy. If you are using Pombi on behalf of a business, you represent that you are authorized to bind that business to these terms.
02The Service
Pombi provides an AI assistant that helps local businesses answer calls and messages, book jobs, take orders, request payment, follow up with customers, and organize customer records. Features vary by plan and by the integrations you connect. We may add, change, or remove features over time.
03Accounts and eligibility
You must provide accurate information, keep your login credentials secure, and are responsible for activity under your account. The Service is for business use by users 18 or older.
04Subscriptions and billing
- Paid plans are billed on a recurring monthly basis through Stripe at the price shown when you subscribe (for example, Starter and Pro tiers).
- Subscriptions renew automatically until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- Except where required by law, payments are non-refundable and we do not provide partial-period refunds.
- We may change pricing on a prospective basis with advance notice; changes do not affect the period you have already paid for.
05Payments you collect from your customers
If you enable payment collection, your customers’ payments are processed through Stripe and settle into your own connected account — not Pombi’s. Your use of Stripe is subject to Stripe’s agreements, and you are responsible for the goods and services you sell, for taxes, refunds, chargebacks, and disputes. Pombi is not a party to the transaction between you and your customer and is not a payment processor or money transmitter.
06Your customers and consent (important)
You are responsible for your communications with your own customers. You represent that you have the necessary rights and consents to have Pombi place and receive calls and text messages on your behalf, to record and transcribe calls where you enable it, and to contact your customers, in compliance with applicable laws — including the TCPA, call-recording and two-party-consent laws, and anti-spam rules such as CAN-SPAM. You will honor opt-out requests. You are responsible for any required disclosures to callers that a call may be recorded or handled by an automated assistant.
07AI-generated content
Pombi uses AI to transcribe, understand, and draft responses. AI can make mistakes. Drafts and suggestions are provided for your review, and where the Service asks for your approval you are responsible for reviewing content before it is sent or acted on. You are responsible for the accuracy of business information you provide (such as prices, hours, and policies) that the assistant relies on.
08Acceptable use
You agree not to:
- Use the Service for unlawful, deceptive, harassing, or abusive purposes, or to send unsolicited messages in violation of law.
- Attempt to disrupt, reverse engineer, or gain unauthorized access to the Service or its underlying systems.
- Upload malware, or infringe the intellectual property or privacy rights of others.
- Resell or provide the Service to third parties except as expressly permitted.
09Third-party services
The Service integrates with third parties such as Google, Stripe, Square, and Twilio. Your use of those integrations is subject to the respective provider’s terms, and we are not responsible for third-party services. Connecting or disconnecting an integration is your choice and within your control in the dashboard.
10Intellectual property
We own the Service and all related software, content, and trademarks. You retain ownership of the business content and customer data you provide, and you grant us the limited license needed to operate and improve the Service and to provide it to you.
11Disclaimers
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI output will be accurate.
12Limitation of liability
To the maximum extent permitted by law, Pombi will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues. Our total liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve months before the claim.
13Indemnification
You will indemnify and hold Pombi harmless from claims arising out of your use of the Service, your content, your communications with your customers, or your violation of these terms or applicable law.
14Termination
You may stop using the Service and cancel at any time. We may suspend or terminate access if you violate these terms or to protect the Service. On termination, your right to use the Service ends; certain provisions survive, including those on intellectual property, disclaimers, limitation of liability, and indemnification.
15Changes to these terms
We may update these terms from time to time. When we do, we will change the “Last updated” date above and, for material changes, provide additional notice. Continued use after changes take effect means you accept the updated terms.
